Article 1: Definitions 1.1. “Car company”: Auto Dutch. 1.2. “Customer”: the natural or legal person who enters into or wants to enter into an agreement with Autobedrijf. 1.3. “Vehicle”: all objects sold, rented, repaired, maintained or otherwise processed by Autobedrijf.

Article 2: Applicability 2.1. These general terms and conditions apply to all offers, quotations and agreements in which Autobedrijf supplies products and/or services to the Customer, unless otherwise agreed in writing. 2.2. Any purchasing or other conditions of the Customer do not apply unless they have been accepted in writing by Autobedrijf.

Article 3: Offers and quotations 3.1. All offers and quotations from Autobedrijf are without obligation, unless stated otherwise. 3.2. Obvious mistakes or errors in the offer do not bind Autobedrijf.

Article 4: Prices and payment 4.1. All prices are stated in euros and exclude VAT, unless stated otherwise. 4.2. Payment must be made before or on the invoice date, unless otherwise agreed in writing.

Article 5: Delivery 5.1. The delivery of Vehicles takes place at the agreed place and time. 5.2. The risk of loss or damage to the Vehicles passes to the Customer at the time of delivery.

Article 6: Warranty 6.1. Autobedrijf provides a warranty on the products and/or services supplied in accordance with the legal provisions and the manufacturer’s warranty, unless otherwise agreed. 6.2. The warranty expires if the Customer makes repairs or changes to the Vehicle himself or if the Vehicle has been improperly maintained.

Article 7: Liability 7.1. Autobedrijf is not liable for damage caused by use of the Vehicle, unless this damage is the result of intent or gross negligence on the part of Autobedrijf. 7.2. Autobedrijf’s liability is at all times limited to the amount paid out in the relevant case under Autobedrijf’s liability insurance.

Article 8: Applicable law and disputes 8.1. Dutch law applies to all agreements between Autobedrijf and the Customer. 8.2. Disputes between Autobedrijf and the Customer will be submitted exclusively to the competent court in Amsterdam.

Article 9: Changes to the conditions 9.1. Autobedrijf reserves the right to change or supplement these general terms and conditions. 9.2. Changes also apply to agreements already concluded, subject to a period of 30 days after announcement of the change.

Article 10: Other provisions 10.1. If any provision of these general terms and conditions is void or annulled, the remaining provisions will remain in force. 10.2. Deviations from these general terms and conditions are only valid if agreed in writing between Autobedrijf and the Customer.
